1. Scope and operator
These Website Terms of Use ("Terms") apply to thatturkeysandwich.com and its public and controlled-access webpages, forms, verification pages, and related online services (collectively, the "Website"). The Website is operated under the name That Turkey Sandwich. In these Terms, "That Turkey Sandwich," "we," "us," and "our" refer to the Website operator.
By accessing or using the Website, submitting a form, or selecting a button that is accompanied by a notice linking to these Terms, you agree to these Terms. If you do not agree, do not use the Website or submit information through it. Our Privacy Policy explains how we collect, use, and protect personal information.
2. What the Website does - and does not do
The Website may present That Turkey Sandwich and general brand information, allow an adult to request consideration, and provide approved people with controlled access to selected materials or processes. Public pages do not identify a private venue or advertise a specific private event.
A QR code, Website visit, request for consideration, approval status, access credential, completed agreement, contribution, or other interaction with the Website does not guarantee an invitation, admission, guest-list placement, membership, event frequency, or access to the venue. Invitations and admission decisions remain personal, event-specific, capacity-dependent, revocable, and subject to separate requirements.
Attendance at an event is governed by the applicable Event Participation Agreement and Waiver, event rules, and invitation. Any future Website-based membership, member-host, payment, contribution, rental, ticketing, or similar arrangement requires separate terms and is not created by these Website Terms.
3. Eligibility and accurate information
Public informational pages may be viewed generally, but requests for consideration, controlled access, and guest-related processes are intended only for people who are at least twenty-one (21) years old and legally able to agree to these Terms. Additional age requirements may apply to a specific event.
You must provide accurate information for yourself, keep it reasonably current, and not impersonate another person or submit information for someone else. If displayed identity information is inaccurate, stop and request a correction before continuing.
4. Controlled access and private materials
A password, code, link, session, invitation, or other controlled-access credential is personal and nontransferable. Materials available only after verification, approval, or authentication are "Controlled Materials."
Unless we expressly designate particular material for public distribution, you may not:
- share, forward, publish, post, screenshot, record, reproduce, or distribute Controlled Materials;
- disclose a private event's exact location, access instructions, entry codes, private invitation, guest list, or nonpublic information about another person;
- allow another person to use your credential, device session, approval, or identity to obtain access;
- attempt to discover, index, scrape, or expose protected pages or information; or
- use private information to organize, advertise, promote, imitate, or facilitate an unauthorized event.
You may share only material that we expressly identify as approved for public distribution, and only without altering it in a misleading way. We may suspend or revoke access, invalidate a credential, deny future access, or take other appropriate action if these rules are violated or if access is no longer appropriate.
5. Acceptable use
You may use the Website only for lawful, personal purposes consistent with its intended functions. You may not:
- interfere with the Website, introduce malicious code, overload a service, or bypass a technical or access-control measure;
- probe or test security without prior written authorization;
- use a bot, crawler, scraper, automated extraction tool, or similar method to collect Website content or personal information;
- harvest contact information, stalk, harass, threaten, dox, or invade another person's privacy;
- misrepresent your identity, approval, affiliation, invitation status, authority, or connection with That Turkey Sandwich, the Website, or any protected activity;
- copy or redirect a QR code, domain, page, or form in a way that misleads people about its source; or
- use the Website or its content for fraud, unlawful activity, unauthorized promotion, or infringement of another person's rights.
6. Names, logos, and Website content
The Website and its original text, graphics, photographs, video, audio, artwork, layout, design, software, and other content are owned by or licensed for use by That Turkey Sandwich and are protected to the extent provided by applicable intellectual-property law. We grant you a limited, revocable, nonexclusive, nontransferable license to view and use the Website for its intended personal purposes.
You may not copy, modify, publish, sell, license, create derivative works from, or commercially exploit Website content without prior written permission, except where applicable law permits the use. You may not use the That Turkey Sandwich name, logo, QR code, related public branding, any name or logo disclosed in Controlled Materials, confusingly similar branding, or a Website image in a domain name, social-media identity, merchandise, advertising, event promotion, or other source-identifying use that suggests authorization, sponsorship, or affiliation without prior written permission.
If you submit a request, message, link, photograph, or other material, you retain any rights you already have. You grant us a limited license to receive, store, review, reproduce internally, and use that material as reasonably necessary to evaluate the submission, operate the Website, communicate with you, protect safety and security, and maintain related records. This paragraph does not replace any separate event media or likeness release.
7. Third-party services and links
The Website may rely on or link to third-party hosting, forms, communications, media, security, storage, or other services. Those services may have their own terms and privacy practices. We are not responsible for an unaffiliated third party's content, availability, or independent practices, and a link does not imply endorsement.
8. Communications
If you provide an email address or mobile number, we may use it for request status, identity or access verification, administrative notices, personal event invitations, RSVP records, safety or security communications, and other communications reasonably related to your interaction with the Website or us. Providing contact information does not guarantee that we will contact, approve, or invite you.
These Terms do not create consent to automated marketing calls or texts. If we later offer a marketing-message program, it will use a separate consent and opt-out process as required. You may ask us to stop discretionary communications, but we may retain or send records reasonably necessary for security, legal compliance, an active transaction, or an agreement you accepted.
9. Privacy and security
Our Privacy Policy is incorporated into these Terms by reference. You are responsible for maintaining the security of your device and any credential supplied to you and for notifying us promptly if you believe a credential or protected page has been exposed. No system is completely secure, and we do not guarantee that unauthorized access or service interruption will never occur.
10. Website availability and changes
We may change, suspend, restrict, or discontinue any part of the Website, form, controlled-access process, or available content at any time. We may correct errors and update information, but we do not promise that the Website will always be available, complete, current, or error-free.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.
Website content is general information. It is not a promise of event conditions, an invitation, an admission decision, or authorization for any activity. Information for a particular event is supplied separately and may control over general Website content.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THAT TURKEY SANDWICH AND ITS WEBSITE SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF OR INABILITY TO USE THE WEBSITE, LOSS OF WEBSITE DATA, UNAUTHORIZED ACCESS CAUSED BY YOUR FAILURE TO PROTECT A CREDENTIAL, OR RELIANCE ON GENERAL WEBSITE CONTENT.
This limitation concerns the Website and does not replace the Event Participation Agreement and Waiver or limit liability that applicable law does not permit the parties to limit.
13. Responsibility for violations
You are responsible for loss, damage, claims, and reasonable costs to the extent caused by your unlawful conduct, infringement, unauthorized disclosure of Controlled Materials, misuse of another person's information, or material violation of these Terms. This section does not require you to cover loss caused by our own negligence or other fault.
14. Suspension and termination
We may suspend or terminate Website access, reject or close a submission, or invalidate a credential when reasonably necessary to protect the Website, That Turkey Sandwich, a protected activity, another person, private information, or legal compliance. Provisions that by their nature should survive - including intellectual-property, confidentiality, responsibility, disclaimer, limitation, and dispute provisions - remain effective after access ends.
15. Tennessee law and venue
Tennessee law governs these Terms, without regard to conflict-of-law principles. Exclusive venue for a court proceeding concerning these Terms or the Website lies in a state court of competent jurisdiction in Washington County, Tennessee, or, if federal jurisdiction exists, the United States District Court serving Washington County.
16. Changes to these Terms
We may update these Terms prospectively. The current version and effective date will appear on this page. If a change materially affects an existing controlled-access relationship, we may provide additional notice or require renewed acceptance before continued controlled access.
17. General terms and contact
If a provision is invalid or unenforceable, it will be narrowed or severed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign your controlled access or rights under these Terms without written permission. These Terms and the Privacy Policy are the complete agreement governing Website use, except that separate agreements govern event participation and any future membership, member-host, payment, or similar arrangement.
